Terms and conditions

ARTICLE 1 – DEFINITIONS
In these general terms and conditions the following definitions apply:

1. Consumer: any natural person who acts for purposes that fall outside his/her business or professional activity;

2. Agreement outside the sales area: any agreement between BikeBuddy's and the consumer that is concluded in a place other than the digital or physical sales area
from BikeBuddy's. The agreement is concluded using a means of distance communication, immediately after the consumer has been addressed personally and individually at a place that is not the trader's sales premises;

3. Customization: the products manufactured by BikeBuddy's are customized and are manufactured based on consumer specifications, which are not prefabricated and are based on individual choices and/or decisions of the consumer
made;

4. Sustainable data carrier: any tool - including e-mail - that enables the consumer to store information addressed personally to him in a manner
which makes this information accessible for future use for a period of time that is
adapted to the purpose for which the information is intended, and which allows an unchanged display of the stored information;

5. Reflection period: the period within which the consumer can revoke the purchase outside the sales premises, which period starts on the day on which the purchased item is received by the consumer;

6. Withdrawal: the consumer's ability to withdraw from the contract
sales space.

ARTICLE 3 – APPLICABILITY
1. These general terms and conditions apply to every offer from BikeBuddy's and
on any agreement concluded between BikeBuddy's, the consumer or
any other purchasing party.

2. These general terms and conditions will be made available to the consumer no later than before or upon conclusion of the agreement.

3. If the agreement is concluded outside the sales premises, notwithstanding the previous paragraph and before the agreement is concluded, after the agreement of the

ARTICLE 4 – OFFER

2. The offer contains a complete and accurate description of the products offered. The description is sufficiently detailed to enable a good assessment of the offer by the consumer. In case BikeBuddy's use

do not bind BikeBuddy's.


ARTICLE 5 – AGREEMENT
1. The agreement is concluded, taking into account the provisions of Article 4

Article 6 – USE & LIABILITY
1. An electric bicycle (e-bike) may travel at a maximum speed of 25 km/h on public roads

ARTICLE 7 – WITHDRAWAL/CANCELLATION
1. When purchasing products outside the sales area (online), the consumer has it
right to terminate the agreement without giving reasons during the period
period of fourteen days from the day of delivery of the product.
The products that the consumer does not wish to keep must be returned within 14 days after the date of delivery
to have a return request on the day of notification of the withdrawal
requested. BikeBuddy's is entitled to withhold refunds until
BikeBuddy's has received the product back intact, complete and in new condition.
BikeBuddy's recommends using the original packaging for returns

7. Any agreements concluded by the consumer with third parties, including
but not exclusively bicycle insurance or credit agreement, the

ARTICLE 8 – SERVICE AND WARRANTY
1. The warranty conditions referred to in this article 7 apply to new ones
electric bicycles ('E-bikes'), which a consumer purchases directly from BikeBuddy's, or via
one of BikeBuddy's partners, has purchased.
2. The warranty cannot be invoked: • without the original purchase receipt
from BikeBuddy's; • with regard to E-bikes purchased from a third party, such as
a (professional) intermediary.
3. A limited warranty applies to showroom models or second-hand E-bikes
twelve (12) months or 500 kilometers. This warranty only applies to
consumers.
4. BikeBuddy's gives a warranty on material, manufacturing and use of the E-bike
assembly errors. The warranty covers all components that ensure that the
E-bike is operational, with the exception of wearing parts (paragraph 9).
5. BikeBuddy's cannot guarantee that undisturbed use can always take place
made from the E-bike and cannot guarantee optimal driving comfort.
Ease of use and driving comfort depend (partly) on factors where BikeBuddy's
has no control over, including the personal choice(s) of the
consumer or weather conditions.
6. The warranty period commences on the delivery date as stated on the original delivery
receipt for the relevant E-bike.
7. In addition to the legal warranty on new E-bikes, a general warranty of 6 applies
months on newly purchased parts.
8. Provided that the warranty conditions as referred to in this article 7 have been met, repairs
or BikeBuddy's will replace the defective part in such a way that the E-bike
is operational again in BikeBuddy's reasonable opinion. BikeBuddy's is possible
replace a defective part with an equivalent, non-defective part. This
can also mean that the replacement part is not new, but used or
has been refurbished.
9. Wear and tear is excluded from the warranty. The following parts of the E-bike are in
in any case subject to wear and tear ('wear parts'): chain or belt, derailleur and
derailleur wheels, sprockets, inner and outer tires, handles, lamps,
brake pads and brake discs, brake oil, saddle, pedals, straps and paint.

13. Defects or damage that affect the operation of the E-bike
must be submitted immediately and in any case within 48 hours of discovery

17. At BikeBuddy's discretion, any part that BikeBuddy's may use during a
repair or service, automatically become its property. BikeBuddy's is there

18. Any use of the E-bike after a defect or damage has been discovered
is at the expense and risk of the consumer or user of the E-bike;
BikeBuddy's is not responsible nor liable for (further) damage resulting from

consequential damage, including loss of income, immaterial damage, loss

ARTICLE 9 – PAYMENT

1. Unless otherwise agreed, payment must be made no later than upon delivery of the item

ARTICLE 10 – DELIVERY
1. The delivery times stated by BikeBuddy's are indicative; one specified
delivery period is not a strict deadline within the meaning of Article 6:83 sub a of the Dutch Civil Code. If

the consumer will be notified of this as soon as possible. As actual
delivery will be longer than 120 days from the specified indicative delivery period

ARTICLE 11 – RESERVATION OF TITLE
1. All products supplied by BikeBuddy's remain the property of BikeBuddy's until
